Acceptance of Terms
By accessing or using the Clawswarm website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Description of Service
Clawswarm provides AI automation as a managed service for small businesses. We offer two delivery models:
- Hosted: We host and manage your AI assistant in the cloud.
- In-Person: We ship a pre-configured Mac Mini to your location and manage it remotely.
Clawswarm configures, maintains, and supports the AI assistant on your behalf. Both delivery models include ongoing support, security updates, and new integrations.
Account Registration
To use our services, you must create an account via Google OAuth. You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. Each person may hold only one account.
Payment and Billing
All payments are processed by Stripe. Our services are subscription-based, consisting of a one-time setup fee and a recurring monthly rate. Subscriptions auto-renew each month unless cancelled. You may cancel at any time through the Stripe Customer Portal accessible from your dashboard.
Every plan includes a 30-day money-back guarantee. If you are not satisfied within the first 30 days, contact us for a full refund.
Acceptable Use
You agree not to:
- Use our services for any illegal activity.
- Attempt to reverse engineer, decompile, or disassemble any part of our platform.
- Share your account credentials with others.
- Use excessive automated access that degrades service for other users.
Intellectual Property
Clawswarm owns all rights to the service platform, including its software, design, and documentation. You retain full ownership of your business data processed through our service.
Service Availability
We strive to provide reliable, uninterrupted service but do not guarantee a specific uptime percentage. We may perform planned maintenance with advance notice. We are not liable for downtime caused by factors beyond our reasonable control.
Termination
You may cancel your subscription at any time through the Stripe Customer Portal. Clawswarm may terminate your account for violation of these terms. Upon termination, your data will be available for export for 30 days, after which it will be permanently deleted.
Limitation of Liability
To the maximum extent permitted by law, Clawswarm shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services. Clawswarm's total liability for any claim related to our services is limited to the fees you paid to Clawswarm in the 12 months preceding the claim.
Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.
Changes to Terms
We may update these Terms of Service from time to time. We will provide at least 30 days notice for material changes. Your continued use of our services after the effective date of any changes constitutes acceptance of the updated terms.
